Common questions

I have been served with a Statement of Claim. What should I do?

Do not ignore it. In NSW, the general time limit for filing a Defence is 28 days after service unless the court directs otherwise.

Is there a time limit for starting a claim?

Yes. Limitation periods apply, and they vary depending on the type of claim. For many contract claims the general period is six years, but shorter periods apply to some claims. Get advice early.

Do I have to go to trial?

Not necessarily. Many disputes are settled through negotiation or mediation.

I have been charged with a criminal offence. What should I do first?

Do not discuss the matter with police without advice, collect any documents you have received and contact a lawyer before your court date.
